A panel of lawyers is to be appointed in the Supreme Court and High Court on the cases of violence in Delhi. Arvind Kejriwal government of Delhi and Lt. Governor are seen face to face once again on this issue. The Kejriwal cabinet has refused to approve the panel of lawyers made by the Delhi Police, rejecting the suggestion of the Lieutenant Governor.
The Kejriwal cabinet has approved the same panel of lawyers for lobbying cases related to violence, which was not approved by the Lieutenant Governor. The Lieutenant Governor had written a letter to Chief Minister Arvind Kejriwal asking him to keep it in the cabinet. In the cabinet meeting held on Tuesday, the panel of lawyers made by the Delhi Police was rejected. The Delhi cabinet said that the police investigation regarding the Delhi violence has not been considered fair by the court. In this case, due to the approval of the Delhi Police panel, fair trial of the case is not possible.
Kejriwal cabinet agreed with the Lieutenant Governor that this case is very important. For this reason, the Delhi government has instructed the Home Department that a panel of good lawyers be formed for this. It has also been said that the panel should also be impartial. There was also an opinion in the Kejriwal cabinet meeting that those who are guilty of communal violence in Delhi should be punished severely. It was also decided that the innocent should not be harassed or punished.
The cabinet also said that permission to appoint a lawyer cannot be given to the investigating agency. It is unfortunate for the Lt. Governor to interfere repeatedly in deciding the panel of lawyers. Whereas the Constitution Bench of Hon’ble Supreme Court has clearly stated in its order dated 04.07.2018 that the Lieutenant Governor can exercise his authority only in rare cases. The Lt. Governor had written a letter to the Chief Minister for taking a decision in the cabinet, disagreeing with the panel set up by the Delhi government.
Explain that Delhi Police had sent a proposal to appoint six senior lawyers including Tushar Mehta and Aman Lekhi to the Delhi government as Special Counsel in the High Court and Supreme Court in 85 cases related to North East riots and Anti CAA Protest. The Delhi government rejected this proposal of the Delhi Police and said that Delhi government’s lawyer Rahul Mehra and his team are capable of getting justice in these cases.
After this, Lieutenant Governor Anil Baijal disagreed with the proposal sent by the Home Minister of Delhi and summoned this file using his special power. On the basis of this file, Delhi Home Minister Satyendar Jain and the Deputy Governor met. No decision could be taken in this meeting also. After this, Lieutenant Governor Anil Baijal wrote a letter to the Chief Minister and said that the cabinet meeting of Delhi Government should take a decision in this matter.
The Delhi cabinet rejected the suggestion of the Lieutenant Governor to approve the Delhi Police’s counsel panel. The reason behind this is being told that on the investigation of Delhi Police, the finger was raised on behalf of the court recently. Delhi High Court judge Suresh Kumar had commented on Delhi Police regarding the Delhi violence, “Delhi Police is misusing judicial process”.
The sessions court also questioned the fairness of the Delhi Police. Apart from this, some media reports also questioned the fairness of Delhi Police. In this situation, with the approval of the panel of lawyers of Delhi Police, questions would arise about the investigation of Delhi violence.
