Jammu and Kashmir administration has withdrawn its important order regarding land acquisition. Now in Jammu and Kashmir, Army, Central Reserve Police Force (CRPF), Border Security Force (BSF) will not need to take NOC to take the land.
According to the 1971 circular, the Armed Forces like Army, BSF, CRPF etc. needed to obtain a No Objection Certificate (NOC) from the home department of Jammu and Kashmir. Now this circular has been withdrawn. Jammu and Kashmir is now a union territory, so the rules of the center have come into force here. After the Centre’s rule comes into force, land will now be acquired in Jammu and Kashmir under Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013.
A note issued by the state revenue department states that in view of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013, Circular No. 71 / 13A has been withdrawn which was issued in 1971. Was According to this, the Army, BSF / CRAPF had to take permission from the Home Department for land acquisition.
Now according to the new rule, the collector of every district has been instructed to pursue the process of land acquisition. The Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 allows the Navy, Military, Airforce and Armed Forces to acquire land for strategic actions. Central paramilitary forces and territorial police can acquire land for national security and protection of people.
